What if my builder keeps delaying my closing or occupancy date?A builder can move tentative dates only by proper written notice and never past the outside date without your agreement. Once a firm date is missed, you are generally owed delay compensation under the Tarion addendum, and if the outside date passes you can terminate and get back what you paid, with interest.

Commercial Lease Disputes

What if my commercial landlord changed the locks?In Ontario, a commercial landlord can often change the locks without a court order if rent has gone unpaid for the period the lease or the Commercial Tenancies Act allows, but for other breaches it must first give written notice and time to fix the problem. A tenant who acts quickly may be able to get the premises back by asking the court for relief from forfeiture, usually on paying the arrears and costs.
